Business investors looking to invest in Australia can apply for a business visa. Depending on the investment amount a business investor visa applicant could be eligible for a permanent residence visa or a temporary visa which leads to permanent residence. Below is a comparison of the business visa options available.

BUSINESS TALENT VISA (SUBCLASS 132) (PERMANENT)

This is a permanent residence visa which if granted allows you and your family can reside in Australia permanently.

The Business Talent Visa (Subclass 132) visa has two streams:
  • Significant Business History stream: for high-calibre business owners or part-owners who want to do business in Australia
  • Venture Capital Entrepreneur stream: for people who have sourced venture capital funding from a member of the Australian Venture Capital Association Limited (AVCAL).
ELIGIBILITY REQUIREMENTS

To be eligible for this visa, you must

  • Be nominated by a state or territory government agency
  • Be invited to apply for the visa

and apply under one of two stream:

  • Significant Business History stream
    • You must have an overall successful business career
    • assets of AUD 1.5 million 
    • business turnover of AUD 3 million
    • You must have assets of AUD 1.5 million and business turnover of AUD 3 million
    • or

  • Venture Capital Entrepreneur stream
    • You must have funding of at least AUD 1 million from an Australian venture capital firm.

BUSINESS INNOVATION AND INVESTMENT (SUBCLASS 188)

This visa allows overseas business owners and investors to stay in Australia for four years to manage a business or investment.

There are FIVE streams under the subclass 188 Business Innovation and Investment visa to which you can apply:

  1. Business Innovation stream: for people with business skills who want to establish, develop and manage a new or existing business in Australia. Applicants must be nominated by a state or territory government.
  2. Investor stream: for people who want to make a designated investment of at least AUD1.5million in an Australian state or territory and maintain business and investment activity in Australia. Applicants must be nominated by a state or territory government.
  3. Significant Investor stream: for people who are willing to invest at least AUD5million into complying significant investments in Australia and want to maintain business and investment activity in Australia. Applicants can be nominated by a state or territory government or Austrade on behalf of the Australian government.
  4. Premium Investor stream: for people who are willing to invest at least AUD15million into complying premium investments in Australia and want to maintain business and investment activity in Australia. Austrade will make the initial contact with suitable candidates for nomination on behalf of the Australian government.
  5. Entrepreneur stream: for people who have a funding agreement from a third party for at least AUD200 000 to undertake a complying entrepreneur activity that is proposed to lead to either the commercialisation of a product or service in Australia or the development of a business in Australia. Applicants must be nominated by a state or territory government.

Holding this visa is the first stage before becoming eligible to qualify for a Business Innovation and Investment (Permanent) visa (subclass 888).

  • Be nominated by an eligible government organisation
  • Be invited to apply for the visa
  • Meet certain health and character requirements

    • Have experience in owning and operating a business or
  • Investor stream
    • have at least AUD1.5 million to invest or
  • Significant Investor stream

BUSINESS INNOVATION AND INVESTMENT (SUBCLASS 888)

This visa is the second stage of the Business Innovation and Investment (Provisional) Visa 188. It is intended for business owners and investors to allow them to:

  • Continue to own and manage a business in Australia (the Business Innovation stream)
  • Continue business and investment activity in Australia (the Investor stream, the Significant Investor stream and the Premium Investor stream)
  • Continue entrepreneurial activity in Australia (Entrepreneur stream).

This is a permanent residence visa.

WHAT THIS VISA LETS YOU DO?

This visa lets you and any member of your family unit who has also been granted this visa: 

  • Stay in Australia indefinitely
  • Work and study in Australia
  • Enrol in Medicare, Australia’s scheme for health-related care and expenses
  • Apply for Australian citizenship (if you are eligible)
  • Sponsor eligible relatives for permanent residence
  • Travel to and from Australia for five years from the date the visa is granted (after that time, you will need a resident return visa or another visa to return to Australia).
ELIGIBILITY REQUIREMENTS

To be eligible for this visa, you must:

  • Hold a relevant stream of the subclass 188 visa or 444 visa
  • Be nominated by a state or territory government agency or Austrade

And fulfill the requirement of one of the following streams

  • Business Innovation stream: have owned and operated a business in Australia for at least 2 years or
  • Investor stream: have held a designated investment of AUD 1.5 million for 4 years or
  • Significant Investor stream: have held a complying investment of AUD 5 million for 4 years or
  • Premium Investor stream: held a complying investment of AUD 15 million for 1 year
  • Meet additional financial and other requirements of the same stream of this visa.
